STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

A RESOLUTION condemning the judicial doctrine of "disparate impact".

 

Whereas, the practice of univariate analysis for complex, real-world phenomena is illegitimate and unscientific, rendering such nonsensical conclusions as "thing one happened, then thing two happened, therefore the first thing was causative of the second thing;" and

Whereas, the judicial doctrine of "disparate impact" is reliant upon univariate analysis of complex, real-world phenomena to assign causation and legal responsibility; and

Whereas, this judicial doctrine of "disparate impact" has served to legitimize the wholly illegitimate, anti-constitutional practices of "critical legal theory," with the attendant holistic, phenomenological approach to legal interpretation;

Whereas, holistic phenomenology, as critical legal theory, has no limiting principles, thereby rendering all conceivable connections, second, third, and further order factors as "causative," and therefore legally implicated, eligible for regulatory actions, and imposing liability; now, therefore, be it

Resolved by the House of Representatives: that the judicial doctrine of "disparate impact" must be overturned as a necessary restraint on government and to secure the liberty of the people, the exercise of federalism, and the powers delegated to the several states; and

That copies of this resolution be transmitted to the President of the United States; the members of the New Hampshire congressional delegation; and the Honorable Chris Sununu, governor, state of New Hampshire.
