STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to supportive housing options for individuals with developmental disabilities.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Residential Care and Health Facility Licensing; License Exemption for Supportive Housing Options for Individuals with Developmental Disabilities.  Amend RSA 151:2, II(a) to read as follows:

(a)  Facilities which are operated for the continuing care of one person or 3 or fewer persons in a facility certified by the commissioner of health and human services under RSA 126-A:19 and RSA 126-A:20.  This exemption also applies to buildings that provide residences to both independent individuals and individuals receiving services pursuant to RSA 126-A:19 and RSA 126-A:20.  This exemption also applies to any entity that provides housing to 3 or more individuals receiving services pursuant to RSA 126-A:19 and RSA 126-A:20, provided that individuals are not required to use the entity to obtain personal assistance or any health-related or supportive services beyond room and board.

2  Effective Date.  This act shall take effect 60 days after its passage.
